Kindiki

Activist Joseph Enoch Aura files A Petition Seeking to Remove DP Kithure Kindiki From Office

Activist Joseph Enoch Aura has moved to court seeking to quash the appointment of Kithure Kindiki as Deputy President of Kenya. The activist filed a 215-page petition in the Milimani High Court arguing that Kindiki’s appointment and subsequent ascension into the Office of the Deputy President of the Republic of Kenya was unconstitutional. The activist, through lawyer Harrison Kinyanjui who confirmed the suit, challenged the legality of Kindiki’s appointment. At the core of the petition is the claim that Kindiki is still serving as Interior Cabinet Secretary since no official gazette notice was issued to announce he had vacated the position.  Activist Harrison argued that Kindiki’s appointment contravened the Kenyan Constitution which stipulates qualifications and disqualifications for nomination as president or deputy president among other allegations. “Kindiki’s appointment goes against Article 137 which states that no person can be appointed as deputy president if they are a public officer or acting in any state or other public office. Kindiki is still recognised as Interior cabinet secretary as no gazette notice was issued notifying Kenyans of a vacancy in the position. President Ruto appointed Musalia Mudavadi as acting Interior CS through Executive Order Number 5 which was established on July 5, 2024. The main premise of the Executive Order was to facilitate the formation of a Committee on Public Health. So this renders Mudavadi’s appointment null and void.”  In addition, the activist contended that the process behind Kindiki’s appointment lacked transparency since it did not have the required public engagement and did not go through the required legal procedures. The case will be heard on December 16, 2024.

Gachagua

Gachagua Withdraws Appeal Case Amid Political Realignments

Former Deputy President Rigathi Gachagua has instructed his lawyers to withdraw a petition that he lodged at the Court of Appeal over the empanelment of the three bench judges to hear and determine the case challenging his impeachment. The latest move comes as Gachagua  promised to offer direction to his Mt Kenya backyard following his speedy impeachment.  This has left power struggles at the top of the government, with some wondering what Gachagua will do next, and others agitating for a political appointment from Nyeri to replace Deputy President Kithure Kindiki in the Ministry of Interior. Gachagua’s lawyer told Justices Patrick Kiage, Aggrey Muchelule, and George Odunga that his client wished to have the application withdrawn. The lawyer further argued that the withdrawal request was because the case had been overtaken by the order of events, following the swearing-in of Deputy President Kithure Kindiki. “The impugned bench proceeded to vacate the conservatory orders in a ruling which allowed one Prof Kithure Kindiki to be sworn in as Deputy President. Our stay application is thus overtaken by events, very regrettably.’’ The former DP had filed an appeal at the court seeking the orders of the bench to declare Justices Eric Ogola, Anthony Mrima, and Freda Mugambi bench unconstitutional arguing that it was constituted by Deputy Chief Justice Philomena Mwilu and not Chief Justice Martha Koome as ought to be. This comes after the three-bench judge ruled out Gachagua’s petitions challenging his impeachment by the National Assembly and the Senate. Judges presiding over the case at the Court of Appeal agreed to have the petition withdrawn without any objection. Gachagua’s withdrawal comes at a time when his political lifeline at the Presidency has been dealt a final blow sealed following the swearing-in of Kindiki.

Zimbabwe

Zimbabwe’s Government bans police from using mobile phones while on duty

Zimbabwe’s government has banned “with immediate effect” police officers from using mobile phones while working. The ban was contained in a memo, ordered police officers to abandon their private communication gadgets while on duty. All officers are required to surrender their mobile phones to their supervisors once they get to their stations and only use them during their break time. However, no reasons were cited for the ban in the memo but it is widely believed this could be part of efforts to curb police corruption. “Despite numerous instructions given forbidding use of cell phones whilst on duty by members of the police service, commanders are not enforcing this. No member is allowed to be in possession of a cell phone whilst on duty. Cell phones should only be used during break and lunch timesOfficers in charge of police stations have been ordered to enforce the ban, with threats issued against those who do not comply.Once a member is found with a cell phone whilst on duty, the officer in-charge of the said member will be put to task.” This comes a few days after two traffic enforcement officers were arrested in the capital, Harare, after a viral social media video exposed them taking bribes from public transport vehicles. Police spokesperson Paul Nyathi explained that the two detained officers as bad apples who do not deserve to be serving in the police service. The policy seeks to reinforce what appears to have been a previous order addressed to all stations late last month. Police in Zimbabwe moreover are perceived to be among the most corrupt institutions in that country due to low salaries and poor working conditions.

Trump

Donald Trump elected as US president for second time in incredible win over Kamala Harris

Donald Trump has won the US presidential election defeating Kamala Harris in a stunning political comeback that  sends shock waves across the world. Donald Trump’s win marks a remarkable comeback, four years after he was voted out of the White House and ushering in a new American leadership likely to test democratic institutions at home and relations abroad. The 78 years old was able to  recapture the White House by securing more than the 270 Electoral College votes needed to win the presidency, The former president’s victory in the swing state of Wisconsin pushed him over the threshold. As of 5:45 a.m. ET (1045 GMT) Trump had won 279 electoral votes to Harris’ 223 with several states yet to be counted. Trump’s political career had appeared to be over after his false claims of election fraud led a mob of supporters to storm the U.S. Capitol on Jan. 6, 2021, in a failed bid to overturn his 2020 defeat. Republicans won the US Senate majority, but neither party appeared to have an edge in the fight for control of the House of Representatives where Republicans currently hold a narrow majority. “America has given us an unprecedented and powerful mandate,”  Trump had earlier  addressed a roaring crowd of supporters at the Palm Beach County Convention Center in Florida and declared  his victory.  “America has given us an unprecedented and powerful mandate,”  However his opponent Harris did not speak to her supporters who had gathered at her alma mater Howard University although her campaign co-chair, Cedric Richmond, briefly addressed the crowd after midnight, saying Harris would speak publicly later on Wednesday.
