Blow To Rigathi Gachagua As Court Dismisses Objection To Bench Appointed By Deputy Chief Justice

A three-judge High Court bench has recently declined to disqualify itself from hearing and determining the case filed by former Deputy President Rigathi Gachagua. The bench ruled that the constitution granted Deputy Chief Justice Philomena Mwilu the powers to select a bench of judges to determine a case. While passing the ruling, Justice Mrima referred  to the Constitution which he stated granted authority to the Deputy Chief Justice to act on behalf of the Chief Justice on distinct occasions such as the one challenged by Gachagua’s legal team. “It is, therefore, our finding that the constitutional function of the CJ to assign benches, being an administrative function, can be performed by the DCJ when the CJ, for good reason, is unable to perform. In this case, we do not find any fault in the honourable DCJ assigning judges to sit in this bench more soon when the honourable Chief Justice has not raised any red flag.’’ The bench also dismissed Senior Counsel Muite’s allegations that the three-judge bench was constituted at night without a formal sitting.  According to Justice Fridah Mugambi, the transfer of documents by the judicial officers could have as well been done using electronic means and not necessarily physical means as alleged by Gachagua’s legal team. The impeached deputy president through his legal team had protested the decision by the three-judge bench to hear and determine the case. The legal team argued that the only person who could appoint a bench of judges to hear and determine a petition filed by Gachagua was Chief Justice Martha Koome.

Willis Ayieko Found Dead After Missing For Almost Five Days

After almost five days of frantically searching for Wells Fargo manager Willis Ayieko, he has been found dead. His body was found in a morgue. Willis Ayieko went missing on October 19, while traveling up country to attend a burial in Gem, Siaya County. Afterwards his family appealed on social media via Missing Posters to anyone who might know his whereabouts to report. His body was found in Sabatia, Vihiga County and his abandoned car had previously been found in the same area. The late’s cousin had also taken to social media pleading with Willis’ kidnappers not to harm him.  “This is the fifth night since my cousin, Willis Ayieko, was last seen. It is frightening to me to imagine that I am going to bed without knowing where he is and what has happened to him.I PLEAD with his abductors to release him or at least tell us he is fine. Tell us what it is you want in exchange for his release. Don’t harm him. We want him alive and healthy. His phone which was ringing but not being answered has now gone off.The three men who abandoned his car at a petrol station in Sabatia and left with his luggage are yet to be apprehended.I hope when I awake tomorrow morning, there will be the good news of his recovery alive.” The motive of the murder still remains unclear.

Kenyan Lawyer James Nyaata Onchiri Found Dead Near Kajiado Law Courts

The country’s legal fraternity is currently mourning following the tragic death of a High Court Lawyer James Nyaata Onchiri. According to the Law Society of Kenya President Faith Odhiambo, Onchiri’s body was found lying at one of the prefabricated buildings near the Kajiado Law Courts on October 22. Odhiambo disclosed that she was informed about the advocate’s death by an individual privy to the information.  She further revealed that she decided to visit the scene and upon her arrival, she found the area cordoned off by a team of Directorate of Criminal Investigations officers. Odhiambo, while expressing her heartfelt condolences to the lawyer’s family, noted that the DCI officers from the homicide department had commenced investigations to unravel the root cause of the advocate’s death. “At this point, we do not wish to speculate on the circumstances surrounding the death and we urge the investigating authorities to conduct thorough and swift investigations, to uncover the motive and cause of death.”  She also requested Kenyans with information that could aid the investigations to report to the nearest police station and cooperate with the law enforcement agencies to ensure the perpetrators of the heinous act were brought to justice. Lawyer James Onchiri’s death comes at a time when the legal fraternity is mourning the death of two High Court judges who passed away within the span of one week.  Judge Benard Kipyegon Rugut passed away on Tuesday, October 22 under unclear circumstances.

Anguka Nayo Hitmakers Denies Claims That They Are Working With The Government After Their Mashujaa Day Performance

The Anguka Nayo hitmakers have finally responded to the claims and backlash that has been all over the social media ever since they performed their song for President William Ruto and other dignitaries who had attended the just concluded Mashujaa Day celebrations held in Kwale. Kenyans had adopted the trending song as their fight song during the anti- finance bill protest earlier this year. Due to that, Kenyans viewed the performance as a big mockery to them and citizens who had either been abducted and tortured, wrongfully arrested, suffered bodily harm and most importantly those who had lost their lives during the Reject Finance Bill 2024 protests which ultimately turned to Anti-government protests. Defending their actions, through a statement from their manager, the duo known as Wadagliz argued they weren’t working with the government and their weekend performance shouldn’t be pulled out of context. Further noting that it was all business and nothing more as his clients have no political allegiance to anyone.  “We performed during the Mashujaa Day celebrations because the government wanted us to. That does not mean we support the government.’’ Many  of their fans had shared that they will no longer be listening to any Wadagliz songs accompanied with evidence of them either unfollowing, restricting or deleting the duo’s art, mainly the ‘Anguka Nayo,’ song from their devices and streaming platforms.

Trevor Noah Discloses The Reason He Left Daily Show After 8-year

Former Daily Show host Trevor Noah has recently opened up on why decided  to leave the show after an 8-year. According to Trevor, he felt it was time for a change, further admitting that he had, at times, neglected his personal life in favor of his career. “The pandemic was a moment where many people were forced to stay indoors, but I didn’t stop. I was making the show from home. I had prioritized work over everything else, and my friends and family came second. I would only see my friends when I wasn’t working, and everyone knew that. During the pandemic, I also realized I had been at the show for eight years and that I couldn’t do it forever. There were many factors that led to me leaving The Daily Show, but ultimately, I felt it was time.” In December 2022, while hosting the show, Trevor bid farewell to his fans after eight years and he took time to give his remarks.  “Don’t be sad. It doesn’t feel like seven years. Well, not at the desk. Obviously, I went home in between. But still, it’s been a wild ride.” Noah had taken over The Daily Show in 2015 from long-time host Jon Stewart, whose 16-year run had turned the show into a late-night favorite. The comedian worked as a correspondent on the show for a few months before being selected as the new host. Trevor also revealed that he faced a lot of hate when he first started hosting the show. “It wasn’t easy. I would receive messages from people telling me to go back to where I came from.”

Dastan Omari Says Rigathi Gachagua Will Continue Serving As DP Until 2027

Renowned Kenyan lawyer Dastan Omari has revealed that impeached deputy president Rigathi Gachagua will remain in his office serving the people until the next general election that is in 2027. Talking to journalists outside the Milimani Law Courts on October 22, Omari stated his scepticism about the court’s process and predicted that the Supreme Court would eventually decide the case.  He further questioned how a court that is on the spot for violating the law would preside over a case in which rigathi Gachagua is accused of acting contrary to the constitution.  “Did you see the deputy president in court? Remember, the removal of the deputy president is being pushed on the grounds of violating the constitution. Now, the court itself has violated the constitution. So what authority does that court have to remove him?’’ According to him, Gachagua’s case would not end at the current level in the High Court but would move to the Court of Appeal, and ultimately, the Supreme Court would have the final decision. “We are saying that this case will end up at the Court of Appeal, and from there, the final ruling on Gachagua will be made by the Supreme Court. So Kenyans, expect this case to drag on for about three years before it is concluded.’’ Talking about the president, Omari revealed that President William Ruto would have to testify in court to be cross-examined after filing an affidavit regarding the case further questioning whether the president fully understood the implications of filing an affidavit in such a case. “I’m not sure if his lawyers explained to him the implications of the president swearing an affidavit in such a case.’’

Ferdinand Waititu Arrives In Court To Show Support To Impeached DP Rigathi Gachagua

Former Kiambu governor Ferdinand Waititu has gone to the Milimani law court to show his support to the impeached deputy president Rigathi Gachagua this afternoon. Earlier today the High Court was forced to adjourn after the legal teams representing the impeached deputy president and other parties went at each other forcing the judges in the case to announce temporary adjournment. Something that followed a heated debate and legal exchange between impeached DP Rigathi Gachagua’s team and the court regarding the composition of the three-judge bench hearing the case. According to Gachagua’s team, the bench hearing the case was unlawfully constituted and therefore they wanted clarity on the process behind its composition. The three bench judges ruled that the matter and questions raised by Gachagua’s team had heavy implications and thus the court would not proceed with the confusion. The presiding judge, Ogola directed Gachagua’s lawyers to file a different petition in regards to their demands, after which the session would resume at 2 pm for a ruling to be made. ”This court has the control of the proceedings and this is a very weighty matter, it concerns the Deputy President of this country, I will not allow everybody to speak because if everybody is going to speak, we are going to head in post, on the validity of this bench to sit. This is the direction we are making, the application challenging the validity of this court to sit must be filed within one hour and responded to within one hour. We will come to listen to that application.’’ President Ruto through his lawyer has also filed a petition challenging the High Court’s power to hear Gachagua’s petition and according to him the petition should be handled by the Supreme Court.
