Nairobi Governor Johnson Sakaja Misses Gachagua’s Impeachment Trial At The Senate

Sakaja misses Gachagua’s impeachment trial at the senate where he was expected to be a key witness. He was in Mexico City for the Bloomberg Citylab summit. Nairobi Governor Johnson Sakaja’s absence at D P Rigathi Gachagua’s first impeachment trial on Wednesday has raised a lot of questions. Sakaja, who was expected to be a key witness in the Senate trial, was listed by Senate Speaker Amason Kingi among the National Assembly’s witnesses. However, he was nowhere near Parliament when the session started. The governor was in Mexico City for the Bloomberg CityLab 2024 summit, where he featured as one of the keynote speakers. An event schedule confirmed that the Sakaja joined discussions on urban governance, highlighting the role of youth in shaping city policies. “Later today, Bloomberg CityLab reporter Fola Akinnibi will join Governor H.E. Sakaja Arthur Johnson of Nairobi, Kenya, to talk about what cities can learn from putting young people at the heart of decision-making.’’ The Nairobi Governor was expected to shed light on accusations levelled against the Deputy President, which form the basis of an impeachment motion tabled by Kibwezi West MP Mwengi Mutuse. He had submitted an affidavit which accused Gachagua of unlawfully interfering with Nairobi County’s operations, including the relocation of traders from Wakulima Market to Kangundo Road Market.  According to the affidavit, the Deputy President allegedly violated the principle of separation of powers by holding rallies that incited the public against lawful county decisions. Moreover, Sakaja accused Gachagua of using ethnic sentiments to disrupt efforts to reorganise traffic within Nairobi, particularly in relocating matatu terminals. He argued that such actions undermined the county government’s mandate and questioned the integrity of devolution in Kenya. His absence from the Senate hearing caught many by surprise, including Gachagua’s lawyer Ndegwa Njiru, who took to X social media platform to express his anticipation of cross-examining Sakaja.

CS John Mbadi: “Kenyans must understand that if a system is not working we get a system that is working’’

CS Mbadi confirms that the government has no plan of changing the new health model SHA. According to him, the exercise needs patience. The Treasury Cabinet Secretary John Mbadi has recently maintained that the government would not change the Social Health Authority despite appeals by many Kenyans over challenges in accessing healthcare. Speaking during an interview on Spice FM, Mbadi clarified that the challenges witnessed during the transition from NHIF to SHA were minimal to warrant an overhaul of the new health insurance system. He further disclosed that the solution to the current crisis within the health sector was not affecting the whole system but rather correcting the glitches faced during the implementation of the health scheme. “Kenyans have been questioning why we have SHA and not NHIF, the latter was not working, Kenyans must understand that if a system is not working, we get a system that is working, it may have challenges from the beginning but that does not mean we get back to a system that does not work.’’ He also noted that exercising patience on the matter would be better, stating that the government was working to restore normalcy by correcting the hitches. CS Mbadi went ahead to compare Kenyans to Lot’s wife, a figure in the bible who turned into a pillar of salt after looking back at the destruction of Sodom and Gomorrah as her family was fleeing. “The problem with us is that if we attempt to get something to work then we have challenges, instead of correcting challenges and moving forward, we tend to go back,” CS Mbadi commented.Kenyans tend to think like Lot’s wife who was told not to look back but she looked back and remained at the same place. So we need to be looking forward. If SHA has challenges, we need to deal with these challenges.” CS Mbadi’s move comes barely hours after Health Cabinet Secretary Deborah Barasa announced that a task force had been established to ensure all Kenyans, including cancer patients and those on dialysis,  access essential healthcare services.

HELB Disbursement Secured After A Successful Meeting Between KUSO And Education CS

KUSO secures HELB funds disbursement after a meeting with education CS Julius Ogamba. Students who rely on the funds are expected to receive the funds within the next one to two  days. The Kenya University Students’ Organization  has finally assured university students that the Higher Education Loans Board disbursement is on track. This comes after a meeting with Education Cabinet Secretary Julius Ogamba and Principal Secretary for Higher Education, Dr. Beatrice Inyangala. During the meeting, the CS and PS confirmed that the Treasury successfully released funds on October 13th. According to them, those funds have already reflected in the Ministry of Education’s account, making it possible for the processing and disbursement of all pending HELB batches to commence. They further noted that students should receive the funds within the next one to two days.   This confirmation brings relief to many students who have eagerly waited for their loans, as they rely on these funds for their academic and personal needs.

Gachagua Advised To Resign As The DP After The High Court Refuses To Stop The Tabling Of His Impeachment Motion At The Senate

Gachagua advised to resign before the senate make its decision. The DP’s impeachment motion is currently being tabled at the senate Deputy President Rigathi Gachagua is currently under pressure after the court refused to halt the tabling of his impeachment at the senate. Many are advising him to just resign willingly instead of waiting to be impeached by the senate. In ruling that refused to halt the process, Justice Mwita acknowledged that the court’s authority to intervene in cases of constitutional infringement but maintained that Parliament had the right to hear and determine the impeachment motion as part of its mandate as a state organ. “Having considered the application and argument by parties, the Constitution, and the precedent, the prayer for the grant of conservatory order is hereby declined.” Following this High Court’s decision, many and especially  prominent lawyer Ahmednasir Abdullahi  have urged Gachagua to resign before the Senate impeachment trial begins. Abdullahi warned that Gachagua has a limited window to make this decision, stressing that stepping down now could save his political future. “Hon. Rigathi Gachagua has a very short window to resign. If he wants to have a new lease of life in politics, he must resign before the impeachment motion kicks off in the Senate.’’ Last week the DP  was impeached by Members of Parliament. Gachagua becomes the first DP to go through the impeachment process since the implementation of the 2010 constitution.

Kimani Mbugua seems to have undergone an impressive transformation months after being in rehab. He has been battling mental health issues for a while now. A video showing former Citizen TV presenter Kimani Mbugua in rehab has really circulated all over social media. The video shared on his Tiktok account shows the ex-journalist at a rehabilitation hospital entertaining people with Sauti Sol’s song ‘Feel My Love.” Kimani Mbugua asked fans to start following his new tiktok account where he will be sharing content. Early this year, the ex-journalist left Kenyans wordering after a worrying trend of social media posts. Kenyans among them comedian and media presenter Oga Obinna came to his rescue. Former Nairobi governor Mike Sonko also offered to take him to rehab.  After he was taken to the rehab his father updated fans on his progress in May. “At the moment he is still out of balance, I thank God because we normally as Christians pray and ask God to do what we cannot do, Kimani is not yet well.” Kimani has been battling mental health issues, and his appearance online often elicits concern. His dad in May had revealed that Kimani began experiencing mental health problems after his drink was allegedly spiked at a party. Kimani is said to be at the Mombasa Mental Rescue Center.

Blow To DP Gachagua Again As High Court Refuses To Halt The Hearing Of His Impeachment At The Senate

The court refuses to stop the tabling of Gachagua’s impeachment at the senate.  The hearing of the impeachment is set to start from 16th October to 17th October. The High Court has rejected Deputy President Rigathi Gachagua’s attempt to halt the Senate’s upcoming impeachment proceedings. Justice Chacha Mwita delivered the ruling dismissing Rigathi Gachagua’s petition that sought to restrain the Senate from acting on the National Assembly’s resolution passed on October 8.  This ruling allows the impeachment process in the Senate to continue. “Having considered the application and argument by parties, the constitution, and the precedent, the prayer for the grant of conservatory order is hereby declined.’’ According to the Justice, the Constitution has delegated the impeachment process to Parliament, and the court must show restraint in meddling with the process. Justice Mwita, however, ruled that the challenges raised in the petition can be considered after the Senate concludes its role. He further ruled that the court had the jurisdiction to hear the petition brought by Gachagua, despite some of the responders to the petition arguing that the court had no jurisdiction since the matter in question stemmed from a constitutional process.  The DP becomes the first DP to go through an impeachment process  and has been  impeached by the MPs since the implementation of the new constitution.

Senate Forced To Adjourn a Setting After Senators Failed To Show Up

A big blow as  many senators fail to attend  a morning setting at the  senate.  This raises questions since they are expected to start tabling Gachagu’s impeachment motion on  16th October. The Senate has recently been forced to adjourn a sitting due to a lack of quorum. Lawmakers were set to discuss a raft of issues but most senators were a no-show with hardly any legislator present at the chambers. “The Senate of Kenya morning session has been adjourned due to lack of quorum pursuant to the Senate Standing Order 40 subsection 2.”  According to the standing orders of the Senate, for the House to transact or do any business of the day there has to be a minimum of 15 senators present in the Chamber. This comes even as the Senate is set to hear the impeachment case against Deputy President Rigathi Gachagua on October 16 and October 17. The Senate is now the key determiner on whether Gachagua will remain in office after the National Assembly voted to kick him out last week.  The deputy president can, however, be saved by the courts. DP Gachagua is facing 11 accusations including; gross violation of the Constitution, insubordination, unlawful acquisition of wealth and threatening national unity through making divisive statements in public. Gachagua has however filed a case in court seeking orders to have the Senate blocked from debating his impeachment. The High Court is expected to rule on Tuesday at 2:30 PM on whether to suspend the impeachment trial .
