Rigathi Gachagua Files A Petition Seeking The Suspension Of The Impeachment Motion Lodged Against Him At The National Assembly

Rigathi Gachagua has filed a petition to try and stop the tabling of the impeachment motion against him. The DP’s petition comes hours before a public participation exercise against his impeachment begins.  Deputy President Rigathi Gachagua has  filed a petition at the High Court seeking the suspension of the impeachment motion lodged against him at the National Assembly. According to the DP’s lawyers, the motion to impeach him was founded on deceit and misrepresentation of material facts. Gachagua’s petition also accused National Assembly Speaker Moses Wetangula and his deputy Gladys Shollei of bias for publicly declaring their stand on how they would prefer Gachagua’s impeachment to go. The petition continues to claim that the move to dismiss Gachagua was unconstitutional and peddled to the public in a bid to achieve unjustified purposes.  Further accusing  the National Assembly of allocating limited time for public participation which he termed as grossly insufficient to facilitate any meaningful and reasonable public engagement. This petition follows three other petitions that were previously filed at the same High Court challenging his impeachment motion.  However, all the previous ones were dismissed thus paving the way for the tabling of an impeachment motion. The petition moreover comes ahead of a public participation exercise that is set to officially begin on 4th October.

High Court Stops The Implementation Of The New Higher Funding Education Model

The High Court has stopped the new funding education model  to be implemented. This comes as many university students have been trying to stop the implementation via protest. The High Court has recently stopped the implementation of the new higher education funding model until the case filed by the Kenya Right Commission and other three petitioners is heard and determined. According to a ruling made by Justice Chacha Mwita, the government led by Attorney General, Education CS and Kenya Universities and College Placement Service delayed in filing its submissions.  The petitioners led by the Elimu Bora Working Group and others argued that the funding model is discriminatory and locks thousands of students out of higher education. The petitioners had moved to court in October last year seeking orders to stop the implementation of the new university funding model. They argued that the new funding model will lock out many students from less privileged backgrounds from accessing university funds. According to the model segmented into 5 bands, students from vulnerable and extremely needy households would receive full funding while the less needy will get up to 90 per cent funding. This  comes as many university students across the country have been protesting calling for the new funding model to be scrapped.
