DP Rigathi Gachagua: “Irrespective of what happens, I am calling for peace in Embu, Mt Kenya and all of Kenya.”

Gachagua urges Kenyans to remain peaceful no matter the outcome of his impeachment. His comment comes with a few days remaining for the senate to decide his fate in the political career. Deputy President Rigathi Gachagua today was seen in public for the first time since he was impeached by the parliament. Addressing the his region, during the 34th diocesan anniversary celebrations at St Mark’s Teachers Training College in Embu, Gachagua  urged calmness regardless of the outcome of his impeachment. ‘’Irrespective of what happens, I am calling for peace in Embu and Mt Kenya and all of Kenya. We only have one Kenya and not any other country.’’ However the DP did not go deeper into the matter of the impeachment noting his confidence in the judiciary.  “We have faith in our courts, and I am certain that our judges will uphold the Constitution and ensure the will of the people prevails.’’ His legal team has filed a petition arguing that he was not given sufficient time to respond to the allegations, which include 11 charges presented by Kibwezi West MP Mwengi Mutuse. Tensions continue to remain in the Mt Kenya region, especially where chaos erupted shortly after Gachagua’s impeachment by the National Assembly, particularly in Gachagua’s home town, where clashes were seen during public participation forums meant to gather input on the impeachment motion. DP Gachagua’s political fate now rests with the Senate, which will examine the evidence and arguments presented by Mutuse.  However, the National Assembly maintains that the courts should not interfere, citing the principle of separation of powers.

Ruto addresses The Reason Why He Canceled His Visit To Embu County

President William Ruto canceled his visit to Embu County so that he can attend the 30th anniversary celebration at AIC Milimani Church. According to the President, he opted to attend the celebration since that’s where he calls home. President William Ruto has finally broken silence on the reason why he decided to cancel his visit to Embu County. Speaking at the AIC Milimani Church in Nairobi, Ruto noted that he opted to attend the church’s 30th anniversary celebration instead, citing a long-standing connection with the congregation. The president was originally scheduled to lead the 34th diocesan anniversary at St Mark’s Teachers Training College, Kigari, but canceled just hours before the event. His absence was notable as it came on the same day  his DP was making his first public appearance since the contentious impeachment vote in Parliament. According to Ruto, his commitment to the AIC Milimani celebration was personal, describing the church as his home further  emphasising  his history with the congregation, recalling how it grew from 10 families to 3,000 members over the years. “I missed the 25-year celebration. I was not going to miss the 30-year one.”   Ruto however did not address the rift within the Mt Kenya region or the impeachment debate, something which has triggered political fallout across the country.  His silence on the matter contrasts with his usual hands-on approach, leaving many to wonder if the cancellation was a strategic move to avoid escalating the situation.

MP

A Motion Changing The Process Of Impeachment for Presidents, Deputy Presidents, and Governors To Be Presented

Petition seeking to change the  process of impeachment in different leadership positions to be filed. According to the petition referendum should be involved before any elected leaders can be impeached. A Member of Parliament has  recently threatened to present a motion changing the process of impeachment for Presidents, Deputy Presidents, and Governors. According to Manyatta MP Gitonga Mukunji, there has to be amendments that would require a referendum before any elected leader can be removed from office.  His  proposal aims to empower voters, ensuring that the decision to impeach rests with the electorate rather than a small group of lawmakers. The petition continues to argue that it is fundamentally unjust for a leader elected by millions to be subjected to the whims of a few. Further  claiming that the current impeachment process is susceptible to misuse, with lawmakers often exploiting it to settle personal grievances.  “When someone is being impeached, the voters should have the final say.”  The Constitution permits the impeachment of Governors and their deputies if a majority of Members of County Assembly support the motion, which after that leads to the senate. MP Mukunji’s proposal seeks to shift this balance of power by mandating a referendum that engages voters directly, ensuring their voices resonate in significant political decisions.  If the motion becomes successful, this reform could redefine the relationship between elected officials and their constituents, transforming the impeachment process into a more democratic and participatory affair.

MP Babu Owino Calls For Daily Protest At Universities Following The Delay Of HELB Funding

Babu Owino calls for daily protests across all universities starting 14th October. This comes after there has been delay in distributing HELB funding.  Embakasi East Member of Parliament Babu Owino is calling for daily protests at universities across the country starting October 14. This comes following the delay in the disbursement of scholarship funds(HELLB). Making the announcement via his X account,  the MP highlighted the growing desperation among students who depend on the Higher Education Loans Board (HELB) for financial support Babu Owino has accused the board of intentionally stalling the release of funds.  “HELB has intentionally decided to delay funds meant to educate our comrades, and as a result, they must suffer. According to him, student leaders across all universities should immobilize the students to a peaceful demonstration. His call for protests comes days after protests at Nyandarua National Polytechnic, where students took to the streets against a fee hike and the cancellation of HELB applications.  There have also been numerous complaints regarding HELB’s sluggish disbursement of funds.  Just last week, a university student shared his distress on TikTok, revealing the consequences of the delayed funds. In August, the Treasury allocated Ksh29.7 billion to the Ministry of Education, which included Ksh5.1 billion earmarked for HELB to assist students pursuing higher education.  However, no distribution has been done yet and this has raised questions about the government’s commitment to student welfare, as many struggle to meet basic needs.

Gachagua

Cases Challenging DP Gachagua’s Impeachment Have Been Referred To Chief Justice Martha Koome

Chief Justice Martha Koome has been given a go ahead by the High Court on the cases filed concerning Gachagua’s impeachment. She is expected to appoint three judges who will hear and determine matter.. The High Court has referred the cases challenging the impeachment of Deputy President Rigathi Gachagua to Chief Justice Martha Koome to appoint three judges to hear and determine the matter. According to Justice Lawrence Mugambi’s ruling, the cases raised serious constitutional questions that required the intervention of the Chief Justice. “In my view, despite stiff opposition by the respondents, it is my opinion that these cases raised weighty constitutional questions that fall under Article 163 hence I am persuaded to refer them to the Chief Justice. The courts do not exist to serve the intellectual stimulation of the elites but to serve the public in matters of great concern and this one is one of those rare occasions that the court should arise to the occasion to serve the public with all the resources that it can summon.” This ruling comes a day after the Deputy President’s legal team claimed that the impeachment of the DP raised several constitutional issues since it was the first time that the country was facing an impeachment of the deputy president since the introduction of the 2010 constitution. In the petition that Muite filed, the impeachment of a deputy president differed from that of the president and even the governor, further stating that the motion to impeach Gachagua did not undergo adequate public participation. He  further argued that Gachagua should have first been allowed to respond to the eleven charges levelled against him before undertaking public participation to allow Kenyans to make informed decisions. “It is not about the number in the National Assembly. There has to be proof of gross violation of the Constitution. The right to a fair trial cannot be limited. There are weighty issues in a presidential system.’’ Gachagua was impeached by Members of Parliament with 281 voting in favour of his removal in the office. He became the first deputy president in the history of Kenya to ever be impeached by Members of Parliament. The same matter is also currently at the senate.
