MP Babu Owino Calls For Daily Protest At Universities Following The Delay Of HELB Funding

Babu Owino calls for daily protests across all universities starting 14th October. This comes after there has been delay in distributing HELB funding.  Embakasi East Member of Parliament Babu Owino is calling for daily protests at universities across the country starting October 14. This comes following the delay in the disbursement of scholarship funds(HELLB). Making the announcement via his X account,  the MP highlighted the growing desperation among students who depend on the Higher Education Loans Board (HELB) for financial support Babu Owino has accused the board of intentionally stalling the release of funds.  “HELB has intentionally decided to delay funds meant to educate our comrades, and as a result, they must suffer. According to him, student leaders across all universities should immobilize the students to a peaceful demonstration. His call for protests comes days after protests at Nyandarua National Polytechnic, where students took to the streets against a fee hike and the cancellation of HELB applications.  There have also been numerous complaints regarding HELB’s sluggish disbursement of funds.  Just last week, a university student shared his distress on TikTok, revealing the consequences of the delayed funds. In August, the Treasury allocated Ksh29.7 billion to the Ministry of Education, which included Ksh5.1 billion earmarked for HELB to assist students pursuing higher education.  However, no distribution has been done yet and this has raised questions about the government’s commitment to student welfare, as many struggle to meet basic needs.

Cases Challenging DP Gachagua’s Impeachment Have Been Referred To Chief Justice Martha Koome

Chief Justice Martha Koome has been given a go ahead by the High Court on the cases filed concerning Gachagua’s impeachment. She is expected to appoint three judges who will hear and determine matter.. The High Court has referred the cases challenging the impeachment of Deputy President Rigathi Gachagua to Chief Justice Martha Koome to appoint three judges to hear and determine the matter. According to Justice Lawrence Mugambi’s ruling, the cases raised serious constitutional questions that required the intervention of the Chief Justice. “In my view, despite stiff opposition by the respondents, it is my opinion that these cases raised weighty constitutional questions that fall under Article 163 hence I am persuaded to refer them to the Chief Justice. The courts do not exist to serve the intellectual stimulation of the elites but to serve the public in matters of great concern and this one is one of those rare occasions that the court should arise to the occasion to serve the public with all the resources that it can summon.” This ruling comes a day after the Deputy President’s legal team claimed that the impeachment of the DP raised several constitutional issues since it was the first time that the country was facing an impeachment of the deputy president since the introduction of the 2010 constitution. In the petition that Muite filed, the impeachment of a deputy president differed from that of the president and even the governor, further stating that the motion to impeach Gachagua did not undergo adequate public participation. He  further argued that Gachagua should have first been allowed to respond to the eleven charges levelled against him before undertaking public participation to allow Kenyans to make informed decisions. “It is not about the number in the National Assembly. There has to be proof of gross violation of the Constitution. The right to a fair trial cannot be limited. There are weighty issues in a presidential system.’’ Gachagua was impeached by Members of Parliament with 281 voting in favour of his removal in the office. He became the first deputy president in the history of Kenya to ever be impeached by Members of Parliament. The same matter is also currently at the senate.

Kenya among Officers Sent to Combat Gang That Killed 70 People in Haiti

Officers mostly from Kenya have been sent off to Haiti by Multinational Security Support Mission (MSS). This was confirmed by the newly elected director of the Haitian National Police (PNH). He said that Kenya would help the local security forces in their war against powerful gangs like Kokorat San Ras and Gran Grif. The gangs in Haiti had become worse to an extent they were demanding 40, 000 per household for “protection” and disrupting transport routes as well. Before the placement was made, a violent gang in Haiti had murdered 70 people in the town of Pont-Sonde. This made thousands of people to flee for their lives with over 6, 270 people seeking shelter from relatives and camps. Gran Grif gang leader claimed that his gang was responsible for the assault and said it was because the police and vigilant groups had targeted his gang members. In the fight against the gangs, the Haitian National police had been a bit overpowered which made them to be in need of assistance. The placement came five days after the incident had happened. Exantus, the director of communications in Haiti said that the mission was to eliminate the gang members and restore peace. He also said that the placement of MMS officers working with specialized units of the Haitan forces would play a pivotal role in achieving the objective. There is hope that the Kenyan Police Service will be a step towards maintaining order.

A Petition Filed Seeking To Block President Ruto From Appointing Another Deputy President

Morara files a  petition seeking to block appointment of another deputy president. According to Morara, the current DP should remain in the office until the court gives its final ruling.   A petition has been filed at  the High Court to block appointment of another deputy president in case Rigathi Gachagua’s impeachment is upheld by the Senate. According to the petition that has been filed at the Eldoret High Court by advocate Morara Omoke, Gachagua should remain in office until all legal challenges surrounding his impeachment are resolved. Rigathi Gachagua’s impeachment, was passed by the National Assembly on Tuesday with 281 members voting in favour of his removal in the office , something that has shaken the political landscape. Morara insists that no new deputy president should be appointed until the courts have given a final ruling on the matter. Morara in the  petition argues that the impeachment motion was driven by internal disputes within the UDA rather than legitimate constitutional grounds, and claims that the party failed to follow its own dispute resolution mechanisms, violating the doctrine of exhaustion and key constitutional principles. He further asserts that the lack of a statutory framework governing the impeachment of the Deputy President creates a legal vacuum, which should compel the courts to issue conservatory orders to maintain Gachagua’s position. The case has already been certified as urgent and will be heard on October 17, coinciding with the second day of the Senate trial.
